rackAID LLC (“rackAID”) respects the intellectual property rights of others and expects its customers and their users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), rackAID will respond promptly to valid notices of claimed copyright infringement involving content hosted by a rackAID customer. This policy describes how to submit a takedown notice, how to submit a counter-notification, and our policy toward repeat infringers.
Designated DMCA Agent
Notices must be submitted by email to dmca@rackaid.com. Email is required for the fastest processing and is our preferred and primary method for receiving copyright notices and counter-notifications. A physical mailing address is provided below as required by law.

Filing a DMCA Takedown Notice
If you believe content hosted by a rackAID customer infringes your copyright, please email our Designated Agent at dmca@rackaid.com with a written notice that includes substantially all of the following (see 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
- Identification of the material claimed to be infringing, with enough detail to locate it — including the specific URL(s).
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
Incomplete notices may not be valid under the DMCA and may delay our response.
Counter-Notification
If your material was removed or disabled and you believe it was removed by mistake or misidentification, you may submit a written counter-notification by email to our Designated Agent at dmca@rackaid.com that includes substantially all of the following (see 17 U.S.C. § 512(g)(3)):
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before it was removed or disabled.
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the U.S. District Court for the Middle District of Florida), and that you will accept service of process from the person who filed the original notice or that person’s agent.
If we receive a valid counter-notification, we may forward it to the party who submitted the original takedown notice. Unless that party notifies us that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material in not less than 10 and not more than 14 business days after receiving your counter-notification.
Repeat Infringer Policy
In appropriate circumstances and at our discretion, rackAID will suspend or terminate the accounts of customers or users who are determined to be repeat infringers, consistent with our Master Service Agreement and Acceptable Use Policy.
Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. Please be sure your claim is accurate before submitting a notice or counter-notification.
